Event terms & conditions

PLEASE READ CAREFULLY. THIS AGREEMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND ABILITY TO BRING FUTURE LEGAL ACTIONS.

IN CONSIDERATION of being permitted to enter and remain at the premises (the “Venue”) hosting the gathering (the “Event”) organised by EchoLan Limited of Auckland, NZ (“EchoLan”) and in recognition of EchoLan’ reliance, the individual attending the event (“the Attendee”) and, as applicable, on behalf of themselves and their heirs, assigns, executors, administrators, next of kin, and other persons acting or purporting to act on their behalf (collectively, “Related Persons”), hereby acknowledge and agree to the terms below by submitting their registration to the Event.

THE TERMS AND CONDITIONS IN THIS AGREEMENT ARE IN ADDITION TO ANY TERMS AND CONDITIONS ESTABLISHED BY THE VENUE AND ANY OTHER TERMS AND CONDITIONS SPECIFIED BY THE EVENT ORGANISERS. The Attendee hereby expressly waives and releases any and all claims, now known or hereafter known, against EchoLan, and its officers, directors, manager(s), employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, “Released Parties”).

1. ADMITTANCE. In its sole discretion and without refund, EchoLan reserves the right to refuse admittance to or expel from the event anyone that it determines is behaving in a manner that could be disruptive to the Event or pose any danger to any other attendee. The Attendee consents and agrees that in such event, they shall not be entitled to a refund of any portion of amounts paid. Breach of any of the terms herein shall entitle EchoLan to all available legal remedies.

2. ACKNOWLEDGEMENTS OF COVID-19 & OTHER RISKS. The attendee fully understands that: the novel coronavirus SARS-CoV-2 and any resulting disease (together with any variation thereof, “COVID-19”) is an extremely contagious disease that can lead to severe illness and death, and there is an inherent danger and risk of exposure to COVID-19 in any place where people are present; no Safety Protocols (as defined below) can eliminate the risk of exposure to COVID-19; while people of all ages and health conditions can be and have been adversely affected by COVID-19, according to public health authorities (i) people with certain underlying medical conditions are or may be especially vulnerable; and (ii) the risk of severe illness from the contraction of COVID-19 increases steadily with age, and contracting COVID-19 can result in the further transmission of COVID-19 to the Attendee’s spouse, family members, and other persons in proximity to Attendee’s; and exposure to COVID-19 can result in subsequent quarantine, illness, disability, other short-term and long-term physical and/or mental health effects, and/or death, regardless of age or health condition at the time of exposure and/or infection.

The attendee hereby acknowledges and agrees that in the absence of any negligence or other breach of duty by EchoLan or the Released Parties, entry to the Venue and attendance at the Event is entirely at their own risk.

3. ASSUMPTION OF RISKS, HAZARDS AND DANGERS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SAVE IN RELATION TO INSTANCES OF GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL/WANTON CONDUCT, OR INTENTIONAL ACTS BY ECHOLAN AND THE RELEASED PARTIES, THE ATTENDEE, ON BEHALF OF ITSELF AND RELATED PERSONS, HEREBY FULLY UNDERSTANDS AND KNOWINGLY, VOLUNTARILY AND IRREVOCABLY, ASSUMES ALL RISKS, HAZARDS AND DANGERS RELATED TO ENTRY INTO, AND PRESENCE IN, AT AND AROUND THE VENUE AND EVENT, WHICH MAY INCLUDE AN INCREASED RISK OF EXPOSURE TO COMMUNICABLE DISEASES (INCLUDING, WITHOUT LIMITATION, COVID-19), VIRUSES, BACTERIA OR ILLNESSES OR THE CAUSE THEREOF, SICKNESS, PERSONAL INJURY, DISABILITY, OTHER SHORT-TERM OR LONG-TERM HEALTH EFFECTS, AND/OR DEATH. THE ATTENDEE HEREBY ACCEPTS PERSONAL RESPONSIBILITY FOR THEIR VOLUNTARY ATTENDANCE AT THE EVENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ATTENDEE HEREBY ASSUMES, ON BEHALF OF THEMSELVES AND RELATED PERSONS, ALL RESPONSIBILITY OF CLAIMS AND POTENTIAL CLAIMS RELATING TO THE RISK, HAZARDS AND DANGERS DESCRIBED IN THIS AGREEMENT SAVE FOR INSTANCES OF GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL/WANTON CONDUCT, OR INTENTIONAL ACTS BY ECHOLAN.

4. RELEASE AND WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ATTENDEE, ON BEHALF OF ITSELF AND RELATED PERSONS, HEREBY ACKNOWLEDGES AND KNOWINGLY, VOLUNTARILY, IRREVOCABLY, AND FOREVER RELEASES, WAIVES, AND DISCHARGES, EACH OF THE RELEASED PARTIES WITH RESPECT TO ANY AND ALL CLAIMS THAT THE ATTENDEE OR ANY OF THE ATTENDEE’S RELEASED PERSONS MAY HAVE (OR HEREINAFTER ACCRUE) AGAINST ANY OF THE RELEASED PARTIES, THAT RELATE TO ANY OF THE RISKS, HAZARDS AND DANGERS DESCRIBED ABOVE IN SECTIONS 2 AND 3, INCLUDING WITHOUT LIMITATION, ANY AND ALL CLAIMS THAT ARISE OUT OF OR RELATE IN ANY WAY TO THE ATTENDEE’S OR RELATED PERSONS’ EXPOSURE TO COVID-19, (COLLECTIVELY, THE “CLAIMS”), IN EACH CASE WHETHER CAUSED BY ANY ACTION OR INACTION (OTHER THAN GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL/WANTON CONDUCT, OR INTENTIONAL ACTS) OF ANY RELEASED PARTY OR OTHERWISE. ECHOLAN SHALL NOT BE LIABLE FOR ANY LOSS, LIABILITY OR DAMAGE TO PERSONAL PROPERTY.

5. LIMITATIONS ON ASSUMPTION OF RISK AND RELEASE OF LIABILITY. FOR THE AVOIDANCE OF DOUBT, NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN (INCLUDING THE ABOVE SECTIONS 3 AND 4), THIS AGREEMENT DOES NOT RELEASE LIABILITY WITH RESPECT TO OR EXTEND TO CLAIMS THE LAWS OF THE STATE OF NEW YORK DO NOT PERMIT TO BE RELEASED OR WAIVED BY AGREEMENT, INCLUDING LIABILITIES ARISING FROM GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL/WANTON CONDUCT, OR INTENTIONAL ACTS.

6. SAFETY PROTOCOLS. Due to the uncertainty related to COVID-19, the Attendee’s admission to the Venue and attendance at the Event is subject to any health and safety policies, assessments, precautions and/or protocols put in place by local, state and federal governmental agencies, the Venue owner/operator, and/or by EchoLan and/or third parties, including requirements relating to face masks and/or enhanced health screenings (which may include a requirement that the Attendee, and any person in the Attendee’s party, be tested for COVID-19 prior to or during the Event and/or provide proof of vaccination against COVID-19) the “Safety Protocols”.  The Attendee acknowledges and agrees to comply with the Safety Protocols.  Failure to comply with Safety Protocols shall automatically terminate any rights that the Attendee may have hereunder; and shall authorize the Venue owner/operator and/or EchoLan (or their respective personnel) refuse admission to the Venue, or eject the Attendee from the Venue and Event, without refund in each case, and subject the Attendee to all legal remedies available to the Released Parties. The Attendee acknowledges that the Safety Protocols are not diagnostic and do not eliminate the risk of exposure to COVID-19.

7. DISCLOSURE OF PERSONAL HEALTH INFORMATION. The Attendee acknowledges that EchoLan and/or the Venue may be compelled, required, or requested to disclose certain private personal information of the Attendee and certain Related Persons to public health authorities and other governmental agencies. Such information may include the results of COVID-19 tests and other health information collected as part of the Safety Protocols. If such disclosure is so compelled, required, or requested, EchoLan will disclose only the portion of such information that is legally required. By accepting below, the Attendee consents to such disclosure and agrees that no additional signed release will be required in relation to any such disclosure.

8. INSURANCE. It is the sole responsibility of the Attendee to arrange appropriate personal insurance appropriate or necessary in connection with their attendance at the Event.

9. PAYMENT. By registering for the Event, the Attendee warrants that they have the authority to authorize charges to the credit card or other method of payment, as applicable. The Attendee understands and agrees that EchoLan is not liable, in any way, for erroneous bill statements or incorrect charges and that should an error occur in billing or debiting, EchoLan’ only responsibility is to correct such error when and if EchoLan receive written notice of such error. All bookings made prior to the Event must be paid in full to guarantee registration. If payment is not made at the time of booking, registration will be provisional. Only one discount at a time can be applied to the Attendee’s event registration fee. If the Attendee is using a discount code the discount will be deducted from the current online price of the item.

10. EVENT AMENDMENTS AND DISCLAIMER. EchoLan and any other organiser of the Event reserve the right to make changes to the agenda, format, speakers, location and any other aspect of the event without notice and without liability to the Attendee. EchoLan may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel or postpone the event, change its venue or any of the other published particulars, or withdraw any invitation to attend. In any case, none of the Releases shall be liable for any loss, liability, damage or expense suffered or incurred by any person, nor will they return any money paid to them in connection with the event unless they are satisfied not only that the money in question remains under their control, but also that the person who paid it has been unfairly prejudiced, about which the decision shall be in their sole and unfettered discretion and, when announced, final and conclusive.

11. SPEAKERS, SPONSORS AND EXHIBITORS. Views expressed by any attendee, speaker, exhibitor or sponsor at the Event are their own. EchoLan shall have no liability for advice given, or views expressed, by any attendee, speaker, exhibitor or sponsor at the Event or in any material provided to attendees.

12. PHOTOGRAPHS, PUBLICITY MATERIAL, RADIO AND TELEVISION AND PRINT MEDIA. Except as otherwise expressly agreed in writing between EchoLan and the applicable party, EchoLan reserves the sole right to use any photographs, recordings, electronic images or publicity material received by or obtained by EchoLan in the course of the event, for whatever use deemed proper by EchoLan. EchoLan has the exclusive right to include photographic, video and other visual portrayals of attendees, sponsors, exhibitors and their exhibits including its contents, in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity and otherwise, without further compensation to the attendee, speaker, sponsor or exhibitor, and all rights titled and interest bearing (including all worldwide copyrights therein) will be EchoLan’ sole property, free of any claims of the attendee, speaker, exhibitor or sponsor or any persons deriving any rights or interest from the attendee, speaker, exhibitor or sponsor.

13. SPONSORSHIPS, TOURNAMENTS, AND GIVEAWAYS. Except as otherwise expressly agreed in writing between EchoLan and the applicable party, EchoLan does not provide any warranty, guarantee or representation of any kind regarding sponsorships, tournaments and giveaways. The Attendee acknowledges and agrees that all goods or services provided as part of any EchoLan sponsorship, tournament, or giveaway are “as is” and without any warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. EchoLan expressly disclaims any liability or responsibility for the quality, performance, or suitability of any goods or services offered from such arrangements and EchoLan shall not be held responsible or liable for any claims, damages, or other issues that arise.

14. PERSONAL INFORMATION. By submitting registration details, the Attendee agrees to allow EchoLan to process all personal information provided in such registration in accordance with the EchoLan privacy policy (available here) and acknowledges that such processing may include such personal information being held by EchoLan on a database and, where legally permitted, being shared with other parties within New Zealand and internationally. The Attendee agrees and acknowledges that any personal information submitted to EchoLan by the Attendee in connection with the Event may be shared with (a) affiliates of EchoLan; (b) event sponsors; (c) third parties providing services specific to the Attendee’s event attendance including, but not limited to: registration providers, event app providers, networking providers; (d) third parties (exhibitors, sponsors, media partners etc.) hosting workshops or exhibits in connection with the Event; and (e) government entities and regulatory authorities as required by law. The Attendee consents to their details being shared with such parties and agrees and acknowledges that such parties may contact the Attendee in the future. The Attendee acknowledges that there may be certain areas of the Event at which the Attendee’s attendance is conditional on the Attendee’s personal information being provided to third parties which have sponsored or are managing such areas. The Attendee further agrees and acknowledges that their personal information will be used to create a delegate list (physical or digital) for the event containing the Attendee’s supplied details. All processing of personal information set forth in this section is subject to applicable data protection legislation. The use that any third parties make of the Attendee’s personal information is outside of EchoLan’s control and, to the extent permitted by applicable law, EchoLan does not accept any liability in this regard.

15. CANCELLATION POLICY. The Attendee may transfer their registration to another individual without any charge, provided that any such individual will be bound by these terms and conditions, as well as any remarks set out on the original registration. Cancellations by the Attendee more than 3 weeks prior to the Event are fully refundable. If the Attendee cancels their registration less than 3 weeks prior to the Event, EchoLan will be obliged to charge the full fee. The Attendee must notify EchoLan in writing of a cancellation, or EchoLan will be obliged to charge the full fee. If the Event must be postponed, the Attendee’s registration will automatically roll over to the new date and platform. If the Event is cancelled the Attendee will be automatically be given a future credit (valid for 12 months from issue) for another event. The Attendee may request a refund in connection with the postponement or cancellation of the Event within one month following such postponement or cancellation. EchoLan shall not be liable to the attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. Attendees are responsible for obtaining the appropriate travel insurance to cover themselves with respect to such eventualities.

16. FORCE MAJEURE. EchoLan shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder (including the holding or hosting of the Event) to the extent such delay or failure is caused by (i) storm, flood, fire, earthquake or other acts of God; (ii) war, invasion, hostilities, terrorist threats or acts, riot, or other civil unrest or violence; (iii) any disease, epidemic or pandemic, including novel coronavirus COVID-19 (together with any mutation, adaptation, or variation thereof), (iv) embargoes or blockades; (v) national or regional emergency; (vi) strikes, labor stoppages, or slowdowns or other industrial disturbances; (vii) any order or guidance from any governmental or quasi-governmental organisation, including without limitation in regard to travel, public gatherings, or health and safety; (viii) disruptions in supply chains, hotel inventory, commercial air travel or other public transportation; (ix) failure of carriers or utilities or equipment beyond EchoLan’ reasonable control; (x) unavailability of the venue through no fault of EchoLan; or (xi) other similar causes beyond the reasonable control of EchoLan. In any such event, EchoLan shall be entitled but not obliged to either provide alternative facilities or venue for the Event and/or reschedule the Event, without liability on the part of the EchoLan. If EchoLan are unable to reschedule or rearrange the event, EchoLan may cancel the Event on the part of the EchoLan and the Attendee will receive a future credit (valid for 12 months from issue) for another event.

17. GOVERNING LAW. The Attendee hereby understands and agrees that this Agreement will be governed by and construed in accordance with the laws of New Zealand. The Attendee and EchoLan hereby consent to the exclusive jurisdiction of any court sitting in New Zealand.

18. The Attendee hereby agrees that if any provision or part thereof contained in this Agreement is declared illegal, unenforceable, or ineffective, such provision or part thereof shall be deemed severable, such that all other provisions contained in this Agreement shall remain valid and binding. All waivers of any provision of this Agreement must be made in writing and signed by EchoLan.

All prices (unless specified) exclude freight and are subject to change without notice (Error & Omissions Excepted).

Consumer Guarantees Act

You have certain rights under the Consumer Guarantees Act 1993 (Consumer Guarantees Act) that cannot be excluded or limited. These terms do not limit or alter your rights under the Consumer Guarantees Act (other than in the circumstances permitted under that Act). You can find more information about your rights under the Consumer Guarantees Act at the Ministry of Business, Innovation & Employment’s website (www.consumerprotection.govt.nz/general-help/consumer-laws/consumer-guarantees-act) and the Commerce Commission’s website (comcom.govt.nz/consumers/your-rights-as-a-consumer).

Agreement

EchoLan Limited agrees to sell and the Customer agrees to buy the goods ordered through EchoLan.

Price

The purchase price is for goods supplied and packed.

The price you pay will be increased by the amount of other taxes and duties which may be applicable and insurance/freight/handling charges (except to the extent already expressly included in the price).

Provided we meet our obligations under the Fair Trading Act 1986, we can revise our prices at any time prior to accepting your order.

Purchase prices are given in New Zealand dollars unless otherwise stated.

You are bound to pay us the price once we accept your order. A quotation does not give rise to a binding contract until you place an order which we subsequently accept.

Payment

The goods you purchase must be paid for before we can deliver the goods to you.

Delivery

Where we agree to transport the goods to a specified place, we will deliver, or arrange delivery of, the goods to that place. Except where otherwise agreed, you will pay for all resulting transportation costs.

If no place of delivery is specified, delivery shall take place at the time when the goods are made available for dispatch at our premises.

We can deliver the goods by installments, and each installment shall be treated as a separate contract.

We will meet any obligations we have under the Consumer Guarantees Act.

All freight charges shall be at your cost unless otherwise agreed and stated.

Returns and Cancelled orders

Without limiting any rights you have under the Consumer Guarantees Act, all goods to be returned must have a Goods Return Authority issued by us. The issue of a Goods Return Authority does not guarantee that we will accept the return.

Changing your mind / purchasing the wrong product by mistake: If you change your mind after making a purchase, or realise you have purchased the incorrect item, you can enjoy the peace of mind that we offer a 7 day exchange policy (excludes special order items). If there is not a suitable product that can be exchanged for your returned item you will be offered a credit on your account or gift card based on the value paid at the time of purchase. Please note, items purchased on finance cannot be exchanged for a gift card. To exchange a product, goods must be sealed / unopened, with packaging in original condition, and we will need to be notified within 7 days of purchase / delivery. Special order items are excluded and cannot be returned / exchanged if you change your mind/purchase the wrong product by mistake.

Incorrectly supplied products: If you have been accidentally supplied the wrong product, EchoLan will supply the correct product (where it is available) or issue a credit / refund. In these circumstances, if the Consumer Guarantees Act applies to the purchase, we will meet our obligations under that Act. Otherwise, if the Consumer Guarantees Act does not apply:

– to supply the correct product the incorrect product will first need to be returned to us;
– we will need to be notified within 7 days of purchase / delivery;
– the incorrect product supplied must be in resalable / unused condition.

Products damaged in transit: If your product has been damaged during transit to your delivery address we will replace your product (if it is available) or issue a credit / refund. In these circumstances, if the Consumer Guarantees Act applies to the purchase, we will meet our obligations under that Act. Otherwise, if the Consumer Guarantees Act does not apply, unless we agree otherwise, you must notify us within 24 hours of delivery in order to be eligible for a replacement, credit or refund.

Products that are faulty upon arrival / first use or otherwise: If the product you received is faulty upon arrival / first use or where the Consumer Guarantees Act applies, the products do not comply with the guarantees under that Act, we will either repair or replace your product, or issue a credit / refund. Without limiting any rights you have under the Consumer Guarantees Act, in order to repair, replace or issue a credit / refund for your faulty product, it will need to be returned to us so we can test and confirm that it is faulty. If the Consumer Guarantees Act applies, we will meet our obligations under that Act, Otherwise, if the Consumer Guarantees Act does not apply, all returns of this nature must be made within 14 days of purchase / delivery..

Express warranty – Products that are faulty within the warranty period: Without limiting any rights you have under the Consumer Guarantees Act, if your product is faulty or has stopped working as intended and is still within the warranty period specified when you purchased your product, EchoLan will repair or replace your product or issue a credit / refund where a suitable replacement is not available. In order to repair, replace or issue a credit / refund for your faulty product, it will need to be returned to us so we can test and confirm that it is faulty. You may also be able to contact the manufacturer directly to arrange a repair / replacement. Returns of this nature can be made any time within the warranty period and it is your responsibility to cover any costs of returning the product to us (NB there is no specific warranty period under the Consumer Guarantees Act).

Testing fees and return freight: If you return a product to us that is not faulty, you may be liable for a testing fee and freight charges to return the product to you.

Restocking fees: In some special circumstances including when products are sold to wholesale customers, we may agree (at our discretion) to accept a return of a product that is not faulty. In these situations there will be a handling fee equal to at least 20% of the goods value. Delivery, service and assembly fees are not refunded at all.

Without limiting any rights you have under the Consumer Guarantees Act:

– faulty goods will be subject to the normal return procedures for the specific brand being returned.
– freight charges will not be credited.

If you purchased on-line, we will arrange for collection of your incorrectly supplied/damaged or faulty goods. This will be at our cost where such charges are our responsibility under the Consumer Guarantees Act, Otherwise, you will be liable for all delivery and insurance charges incurred in respect of returned goods.

Risk and ownership

Risk of any loss, damage or deterioration of or to the goods passes to you on delivery, or if you state to leave goods at a certain location, at the time goods are placed there.

Ownership of the goods remains with us and does not pass to you until you pay all amounts you owe to us.

Guarantees

If you are in trade you agree that the Consumer Guarantees Act does not apply.

Nothing in these terms is intended to have the effect of contracting out of the provisions of the Consumer Guarantees Act except to the extent permitted by the Act.

Except as otherwise required or prevented by laws including the Consumer Guarantees Act, or except as expressly provided under these terms, we are not liable for any claim in relation to any goods we supply to you (including as a result of negligence or otherwise) and all representations, guarantees, warranties and terms of whatever nature, including under the Contract and Commercial Law Act 2017, are completely excluded.

Repairs and replacements

We do not guarantee that repair facilities and parts will be available for the goods.

Use of information

You agree that we (or other members of our group of companies) may obtain information about you from you or any other person (including any credit or debt collection agencies) in the course of our business, and you consent to any person providing us with such information.

You agree that we may give any information we have about you relating to your credit worthiness to any other person, including any credit or debt collection agency, for credit assessment and debt collection purposes.

You must notify us of any change in circumstances that may affect the accuracy of the information you provided to us or our group of companies. (If you are an individual, i.e. a natural person, you have rights under the Privacy Act 1993 to access and request the correction of any personal information that we hold about you.)

Without limiting the above, we will collect, use, store and disclose your personal information in accordance with our privacy policy, available here.

You consent to receiving marketing material from us, including via email, text and any other electronic means. We will comply with our obligations under the Unsolicited Electronic Messages Act 2007 in respect of any commercial electronic messages we send to you.

No liability

Except where provided in the Consumer Guarantees Act, we shall not be liable for any delays or failure in complying with any obligation imposed on us under any contract or for any loss or damage (including indirect or consequential loss of profits, data or damage) as claimed by you.

Except where the Consumer Guarantees Act applies, should any liability in relation to this agreement (or the goods supplied under this agreement) be imposed on EchoLan for any reason, our total liability to you is limited to the price of those goods and services supplied by us to which the liability relates. We will not, in any case, be liable for any consequential or special damages, including loss of business profits.

If we are unable to provide our obligations under the terms of this agreement by reason of strike, lock-out, riot, industrial action, fire, storm, operation of law or other cause beyond our reasonable control, then we are released from our obligations under this agreement.

Other agreements

These terms apply to all transactions where we supply goods to you.

This agreement supersedes the terms of all prior agreements, understandings, representations or warranties previously given by us or any agent of EchoLan Limited in respect of goods.

If there is any inconsistency between these terms and any order submitted by you or any other arrangement with us, these terms prevail unless otherwise agreed by us in writing.

If at any time any provision of this agreement becomes illegal, invalid or unenforceable neither the legal validity nor enforceability of the remaining provisions shall in any way be affected or impaired.

Waiver

If we exercise or fail to exercise any right or remedy available to us, this shall not prejudice our rights in exercising that or any other right or remedy. Waiver of any term of the contract must be specified in writing by us and signed by an authorised person.

Assignment

You may not transfer or assign all or any of your rights or obligations under this contract without our prior written consent.

Governing law

This contract and its terms are governed by, and shall be construed in accordance with, the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the courts of New Zealand.

Sale of Restricted Goods

Sale of Restricted Goods is subject to various laws. By placing an Order for any Restricted Goods you warrant to EchoLan that you are of at least the minimum age required for purchase, use and viewing of the Restricted Goods. When placing an Order for Restricted Goods you warrant that you are not obtaining the Restricted Goods on behalf of a person that is not eligible to purchase, use or view the Restricted Goods themselves.
